He accepted that he had hugged Service User A during the first and the last session but maintained that this had been consensual and had been for therapeutic purposes. 11. In its finding on the facts and current impairment the substantive hearing panel stated as follows: “The Panel considered and discounted the notion that any of the facts came about due to recklessness or being accidental in nature. The Panel was of the view that all the established facts were deliberate and intentional. In the Panel’s view the touching was sexual in nature. The stroking of the ankle up to the knee; the frequency and number of hugs which were close with sniffing of hair and sighing; and particularly kissing on the lips was undoubtedly sexual behaviour. The other behaviour also disclosed a sexual motivation. It was described by Service User A as “coy” with prolonged eye contact making A uncomfortable and feeling that she was being “groomed” due to the escalation of the misbehaviour by the Registrant. The decisions taken by the Registrant also disclosed a sexual motivation. For example, he suggested meeting with Service User A outside the therapy sessions, he asked her to keep this a secret and he asked her to text him daily about how she felt about him. The focus on visiting a cinema and a restaurant being selected instead of help with using buses (which was clinically a more significant problem) demonstrated that the Registrant focused on the area on which there would be greater social interaction. In the Panel’s view the Registrant conducted himself in this way as he was motivated by sexual rather than an innocent consideration. Indeed, he offered no innocent explanation and the Panel could not find any innocent explanation. The context here was that Service Users A...
