Nursing and Midwifery Council determination — review hearing

Struck off the register

The regulator’s term: erasure

What does “struck off the register” mean?

Being struck off (the regulator calls this "erasure") removes the practitioner from the register. They are no longer permitted to practise this profession in the UK. Erasure can be reviewed after a minimum of five years, but is otherwise indefinite.

Concerning Maria Charito Estrella Poblete, nurse (Nursing and Midwifery Council 03G0273O).

Decision date: 8 April 2026 · Hearing started 8 April 2026

In plain English

The NMC found that Maria Poblete, a registered nurse working as a Deputy Sister at a nursing home, did not properly review or assess a vulnerable resident's pressure wounds for several months in 2022, did not update care plans or complete required risk-score forms, and did not escalate the wounds to a senior nurse or specialist. The resident developed serious sacral wounds. She was placed on a 12-month conditions of practice order in April 2025. At today's review she had not engaged with the NMC, so the panel decided to strike her name off the register.

Charges

That, while a registered nurse working as Deputy Sister at a nursing home, in relation to Resident A: (1) did not conduct appropriate reviews or ensure that ongoing assessments were undertaken following documentation of a sacral wound in May 2022; (2) did not ensure that between 18 May 2022 and 1 October 2022 the wound assessment and care plan paperwork was updated; (3) did not ensure that a Braden score was completed in July, August or September 2022; (4) did not ensure that the MUST score was completed between 19 June 2022 and 1 October 2022 (this charge was found NOT proved); (5) prior to 2 October 2022, did not appropriately escalate or seek advice regarding Resident A's pressure ulcers. By reason of the above, fitness to practise was alleged to be impaired by reason of misconduct.

Findings

The original substantive panel on 2 April 2025 found charges 1, 2, 3 and 5 proved (charge 4 not proved), found that the proved facts amounted to misconduct, and imposed a 12-month conditions of practice order. At this first review on 8 April 2026, the panel found that Mrs Poblete had not engaged with the NMC for over a year, had provided no evidence of compliance with the conditions, no evidence of remediation, no reflective statement, and no testimonials. The review panel determined that her fitness to practise remained impaired on grounds of both public protection and public interest, that further conditions or suspension would serve no useful purpose, and directed the Registrar to strike her name from the register, the order to take effect on the expiry of the current conditions order on 6 May 2026.
