The Legally Qualified Chair (LQC) stated that when considering any application, the Tribunal must ensure that the right to a fair trial is maintained and that the proceedings must be fair to both parties in reaching its decision. 19. The LQC said that the Tribunal must have regard to all three limbs of the statutory overarching objective of the GMC as set out in Section 1(1B) of the Medical Act 1983 to: ‘a. Protect, promote and maintain the health, safety and well-being of the public, b. Promote and maintain public confidence in the medical profession, and c. Promote and maintain proper professional standards and conduct for members of that profession.’ 20. The Tribunal must strike a proper balance between fairness to the practitioner and the public interest in the fair and efficient disposal of proceedings, including having regard to the history of the proceedings. 21. The LQC referred the Tribunal to Rule 34 (1) Fitness to practice 2004 which sets out the following: (1) The Committee or a Tribunal may admit any evidence they consider fair and relevant to the case before them, whether or not such evidence would be admissible in a court of law. 22. The decision of whether to admit evidence is for the Tribunal alone to decide and reasons for their decision will be given in writing. The Tribunal must consider all aspects of this application whether it is fair and relevant to admit the matters that the GMC say should be included in the bundle.
