The NMC's Fitness to Practise Committee found that Jophil George's fitness to practise remains impaired following earlier findings of sexually motivated conduct towards a colleague. Reviewing the six-month suspension order imposed in February 2026, the panel decided his insight is developing but still limited. It replaced the suspension with a conditions of practice order for 12 months, requiring him to work for one employer and meet his manager monthly to discuss professional boundaries.
Charges
The charges found proved which resulted in the substantive order were that, on or around December 2022, he hugged Colleague A, put his hand inside Colleague A's t-shirt and, whilst in the training room, kissed Colleague A and grabbed Colleague A's breasts; that on 29 December 2022 he kissed Colleague A; and that on 9 November 2023 he told Colleague A she 'was looking very beautiful' or words to that effect, tried to hug Colleague A and asked Colleague A for a kiss. His conduct was found to have been sexually motivated in that he was seeking sexual gratification in respect of charges 1a, 1b, 1d(i) and 1d(ii).
Findings
This was the first review of a suspension order for six months imposed on 13 February 2026. The panel carried out a comprehensive review and exercised its own judgement. It considered the serious nature of the charges found proved, the vulnerability of Colleague A, who lived at the care home and had recently moved to the UK from India, and the power imbalance between a nurse and a healthcare support worker. It had regard to Mr George's reflective statements, training certificates on professional boundaries, sexual harassment and dignity in care, a reading log, two testimonials and screenshots of job applications. The panel determined that while his insight is developing, it remains limited, noting one brief reference to Colleague A across a 57-page bundle and his position that he does not agree his actions amounted to sexual misconduct. It found continuing impairment on public protection and public interest grounds, and decided workable conditions could be formulated, replacing the suspension order with a conditions of practice order for 12 months taking effect at the end of 18 September 2026.
