The HCPTS panel replaced physiotherapist Arul Rathina's conditions of practice with a three-year caution. Although independent evidence showed he could practise safely, he had not been sufficiently open with his line manager about his restrictions and his insight into that lapse remained incomplete. The caution addressed the remaining risk without restricting practice.
Charges
The original case concerned failure to follow clinical-supervision instructions, treatment of neurological patients contrary to instructions and below the required standard, and broad competency deficiencies in assessment, safety, planning, resourcing, discharge, clinical reasoning and record-keeping.
Findings
The panel found independent evidence that Mr Rathina could now practise safely, but concluded that he had not been sufficiently open with his line manager about his conditions of practice and retained incomplete insight into the impact on colleagues. It replaced the conditions with a three-year caution to address the remaining candour risk.
