The NMC's Fitness to Practise Committee reviewed a nine-month suspension order imposed on Zwelani Charity Ndlovu, a registered learning disabilities nurse, for working two full-time nursing jobs at the same time without telling either employer. The panel considered her new reflective account, training certificates and two testimonials, and decided she is not liable to repeat the misconduct. It found her fitness to practise is no longer impaired and allowed the order to lapse on 10 August 2026.
Charges
Type of case: misconduct. This was the first review of a suspension order of nine months imposed on 8 October 2025. The charges found proved at the substantive hearing were that, between December 2020 and October 2021, while in full-time paid employment with Cygnet Healthcare, Ms Ndlovu obtained full-time paid employment with Mersey Care NHS Foundation Trust contrary to Cygnet Healthcare's job specification; that she did not inform either employer of the other role; that between February 2021 and September 2021 she worked full-time in a clinical setting for both, placing patients at risk of harm by working excessive hours; that on specified dates she was paid to attend training by one employer while being paid to work or train for the other, and received paid study leave from one while being paid to work for the other; that those actions were dishonest in that she did not disclose her additional employment to either employer in order to obtain improper personal financial gain; and that they demonstrated a lack of integrity.
Findings
The reviewing panel carried out a comprehensive review and exercised its own judgement on current impairment. It had regard to new material: a detailed reflective account dated 18 June 2026, training certificates dated between September 2025 and June 2026 covering patient safety and communication, leadership, communication skills in nursing practice, duty of candour, interpersonal skills and decision making, a reading log, and two positive testimonials dated 13 and 17 May 2026. The panel was satisfied that Ms Ndlovu had developed insight into how her actions placed patients at risk of harm and why her conduct was wrong, that she unequivocally accepted responsibility and expressed remorse in specific detailed terms, and that she had applied her learning to each of the charges found proved. It noted she is not currently practising and has been unable to demonstrate safe practice, but was satisfied she has made significant progress in appreciating the seriousness and impact of her misconduct. It determined she is not now liable to repeat matters of the kind found proved, that continuing impairment was not necessary on public protection grounds and no longer required on public interest grounds, and that her fitness to practise is not currently impaired. In accordance with Article 30(1) the suspension order will lapse upon expiry at the end of 10 August 2026.
