Nursing and Midwifery Council determination — review hearing

Struck off the register

The regulator’s term: erasure

What does “struck off the register” mean?

Being struck off (the regulator calls this "erasure") removes the practitioner from the register. They are no longer permitted to practise this profession in the UK. Erasure can be reviewed after a minimum of five years, but is otherwise indefinite.

Concerning Kirsty Victoria James, nurse (Nursing and Midwifery Council 18G0079W).

Decision date: 2 February 2026 · Hearing started 2 February 2026

In plain English

The NMC's Fitness to Practise Committee imposed a striking-off order on Kirsty Victoria James, a registered adult nurse from Cheshire, at a review hearing on 2 February 2026, taking immediate effect. The panel found that she had not engaged with the regulatory process since the original substantive hearing in 2023, had not revalidated, and had provided no evidence of remediation or insight. The original charges included accessing patient records without authority and medication administration failures.

Charges

Original charges found proved in 2023 included: accessing patients' records without authority or clinical reason; attending work in an unfit state, becoming disorientated during a shift and leaving the care home without completing the shift or ensuring adequate nursing cover; failing to complete evaluation sheets for multiple residents over three consecutive nights; and failing to administer multiple medications to numerous residents.

Findings

At the review hearing on 2 February 2026, the NMC's Fitness to Practise Committee found that Kirsty Victoria James's fitness to practise remained impaired. The panel found no evidence of meaningful engagement with the regulatory process or any steps taken to remediate practice since the substantive hearing in 2023. The panel replaced the current suspension order with a striking-off order taking immediate effect pursuant to Article 30(2).
