The NMC's Fitness to Practise Committee reviewed a suspension order imposed on registered midwife Rachel Mugechi Muchoki for a lack of competence and decided her fitness to practise remains impaired. The panel found a continuing shortfall in her clinical knowledge and limited evidence of strengthening her practice. It replaced the suspension with an 18-month conditions of practice order, requiring supervised practice, completion of her preceptorship and a personal development plan, taking effect at the end of 13 July 2026.
Charges
The charges found proved (lack of competence) related to the registrant's failure, between 1 September 2016 and 17 September 2020, to demonstrate the standards of knowledge, skill and judgement required to practise without supervision as a band 5/6 midwife. They included not completing her competencies/preceptorship programme; being slow to record documentation and prioritising documentation over urgent care; being unable to escalate concerns; being unable to operate intravenous pumps or change IV fluids in time; incorrect vaginal examination, catheter insertion and attempted rupture of membranes; inability to demonstrate proficiency in communication, normal labour and birth, medicines management and use of equipment; and, on 11 September 2020, incorrectly discharging a patient with another patient's notes and failing to adequately escalate a baby noted to be 'blue' or having difficulty breathing. Her fitness to practise was found impaired by reason of lack of competence and, in respect of certain charges, her health.
Findings
This was the second review of a substantive order. A suspension order was originally imposed for 12 months on 13 December 2024, and a further 6-month suspension was imposed on review on 4 December 2025. At this review the panel found the registrant's fitness to practise remains impaired on the grounds of public protection and in the wider public interest. It acknowledged her comprehensive reflective piece and some strengthening of practice, but found a continuing shortfall in clinical knowledge, that some training predated the finding of lack of competence, and that she had been unable to put learning into practice, so her lack of competence was likely to be repeated. The panel decided to replace the suspension order with an 18-month conditions of practice order, taking effect at the end of 13 July 2026, requiring supervised practice, completion of her preceptorship package and a personal development plan, to be reviewed before it expires.
