GDC panel finds conduct allegations against dentist Gaetano Fundaro not proved
A GDC Professional Conduct Committee has concluded the case against dentist Gaetano Fundaro, finding allegations that he shouted at a patient and pushed him out of the surgery not proved. The GDC withdrew clinical charges during the hearing, and his fitness to practise was found not impaired.

Charges
It was alleged that on 5 October 2023 Mr Fundaro failed to maintain an adequate standard of care for Patient A by not discussing the need for and costs of fillings at the UR2 and UL3, failed to obtain valid consent, and failed to maintain adequate records; and that on 26 October 2023 he failed to respond adequately to Patient A's concerns about their treatment and failed to treat Patient A with dignity and respect by shouting 'get out, get out' or words to that effect and pushing Patient A out of the surgery. Charges 1-3 (the clinical and record-keeping allegations) were withdrawn during the hearing on the GDC's application.
Findings
The Committee granted the GDC's application under Rule 18 to withdraw the clinical charges (1-3), accepting there was no realistic prospect of a misconduct or impairment finding given the expert evidence that the conduct fell below but not far below the expected standard. On the remaining charge, the Committee found not proved that Mr Fundaro failed to respond adequately to Patient A's concerns, that he shouted at Patient A, or that he pushed Patient A out of the surgery, preferring his evidence and finding inconsistencies in the witness accounts. In accordance with Rule 19(13), as none of the alleged facts was found proved, his fitness to practise was found not impaired and the case concluded.
